MOFCOM Promulgates the Interim Measures on Determining the Trans-Investment of Taiwan Investors through A Third Place (Draft for Comments)
2012年12月21日，商务部发布《台湾投资者经第三地转投资认定暂行办法（征求意见稿）》，现公开征求意见。 意见反馈截止日期为2012年12月31日。
On December 21, 2012, the Minister of Commerce (“MOFCOM”) promulgated the Interim Measures on Determining the Trans-investment of Taiwan Investors through A Third Place (Draft for Comments). The MOFCOM is now seeking public comments on this and the closing date is on Dec. 31, 2012.
征求意见稿明确，台湾投资者以其直接或间接所有或控制的第三地公司、企业或其他经济组织作为投资者（第三地投资者）在大陆投资设立企业（转投资企业），可根据本办法提出申请，将该第三地投资者认定为视同台湾投资者（转投资认定）。
The Draft for Comments specifies that where Taiwan Investors invest in mainland of China by establishing enterprises (Trans-investment Enterprise) through their direct or indirectly owned or controlled companies, enterprises, or other economic organizations in a third place as investors (Third-place Investors), it may apply for this Draft for Comments and such Third-place Investors shall be regarded as Taiwan Investors (Determination of Trans-investment).
The Draft for comments specifies that where a Taiwan investor desires to set up an enterprise (trans-invested enterprise) in China’s Mainland with the third-place company, enterprise, or other economic organization direct or indirectly owned or controlled by it as the investor (Third-place Investors), it may apply to the Measures, and such third-place investor will be regarded as a Taiwan investor (Determination of Trans-investment).
根据征求意见稿，商务部会同国务院台湾事务办公室，各省、自治区、直辖市、计划单列市及新疆建设兵团商务主管部门会同同级台湾事务办公室作为认定部门，负责台湾投资者经第三地转投资认定的管理工作。
According to the Measures, MOFCOM in conjunction together with the Taiwan Affairs Office of the State Council, and the commercial authorities of all provinces, autonomous regions, municipality directly under the Central Government, cities specifically designated in the state plan and Xinjiang Production and Construction Corps in conjunction with the Taiwan Affairs Offices at the same level will be deciding authorities, responsible for the administration on determination of trans-investment of Taiwan investors through a third-place.
