背景介绍
知识共享组织(Creative Commons,简称CC)是一家2001年成立于美国的公益性组织。该组织向文学创作者、艺术家、作曲家以及其他创作者免费提供一系列工具,包括知识共享许可协议(Creative Commons Licenses,简称CC协议)、软件,帮助他们标识自己的作品的权利状态以及其所赋予使用者的使用的自由。
CC协议将著作权利用的模式从传统的“所有权利保留”的模式,发展为灵活的“部分权利保留”模式。
知识共享组织致力于在著作权法领域默认的限制性规则日益严苛的今天,构建一个合理、灵活的著作权体系,倡导、鼓励对知识创造成果合法地分享与演绎。
第一版CC协议(即CC1.0版协议)发布于2002年12月16日,最新版本的CC协议发布于2007年,即CC3.0版协议。
CC协议是全球知识共享运动的标志。为推动CC协议能够在全世界各个司法管辖区适用,知识共享组织发展起一个子项目——知识共享国际合作组织(Creative Commons International,简称CCi)。该项目在各个司法管辖区各成员项目的帮助下,推动CC协议在各司法管辖区的本地化工作。
各个司法管辖区项目负责人由CCi任命,负责组织进行CC协议本地化及推广等工作。CCi并在各司法管辖区有相关的项目合作机构作为项目开展的工作依托。
截止2008年4月,已经有45个司法管辖区正式引入了本地化的CC协议。

知识共享中国大陆项目(Creative Commons China Mainland)是知识共享组织在中国大陆的官方项目,该项目负责CC协议的本地化工作以及推广中国大陆版CC协议。
知识共享中国大陆项目于2005年初开始对未本地化的2.5版CC协议进行翻译、本地化。中国大陆版知识共享协议于2006年3月29日在北京正式发布。
知识共享中国大陆项目由来自法律、艺术和技术领域的志愿者组成项目团队,并由艺术家、学者、法官、政府官员等组成的国际顾问委员会提供支持。
知识共享中国大陆项目的项目依托机构为中国人民大学法学院。
知识共享中国大陆项目由福特基金会提供资助。
CC许 可 协 议 核 心 要 素 说 明
署名:您允许他人对您享有著作权的作品及演绎作品进行复制、发行、展览、表演、放映、广播或通过信息网络向公众传播,但在这些过程中对方必须保留您对原作品的署名。
例如:小红在她的摄影作品上使用了包含“署名”条款的许可协议。小伟在网上找到她的摄影作品并希望在他的网站的首页上进行展示。当小伟将小红的图片放在他的网站上的时候,应当清楚地指明小红是作者。
非商业性使用:您允许他人对您享有著作权的作品及演绎作品进行复制、发行、展览、表演、放映、广播或通过信息网络向公众传播,但仅限于非商业性目的。

Creative Commons China Mainland
Background
Founded in 2001 in the United States, Creative Commons (CC) is a non-profit organization that provides free tools, including the Creative Commons licenses and CC software, for authors, artists, composers and other content creators to easily mark their creative works with the freedoms and/or restrictions they want them to carry.
CC tools change the traditional “All Rights Reserved” statement of copyright into a voluntary “Some Rights Reserved” statement.
CC is dedicated to building a system of reasonable, flexible copyrights in the face of increasingly restrictive default copyright rules. It advocates and encourages legal sharing, remix, and reuse of creative works.
The first version of the CC licenses was released in December 16, 2002. The latest version of the CC licenses, released in 2007, is Version 3.0.
CC licenses have come to symbolize a worldwide knowledge sharing movement. To make local CC licenses available in various jurisdictions around the world, CC has developed an offshoot of its licensing project, Creative Commons International (CCi), which is dedicated to the porting of jurisdiction-specific CC licenses, with help from the member jurisdictions.
The project leads appointed by CCi are responsible for the local CC projects. The local affiliated institutions selected by CCi also act as support institutions to the local CC projects.
As of April, 2008, 45 jurisdictions have now officially launched a local version of the CC licenses.
The Local CC Project in China Mainland
Creative Commons China Mainland is the official local CC project. It is responsible for porting and promoting the China Mainland version of the Creative Commons licenses.
The project started the process of porting the CC licenses version 2.5 early in 2005. The China Mainland version of the CC licenses was officially launched in Beijing on March 29, 2006.
Creative Commons China Mainland is being maintained by a project team consisting of volunteers from various areas of expertise including law, the arts, and technology.
The project is also supported by an International Advisory Board which is composed of leading scholars, artists, judge, government representatives, and key members of the public sector.
The hosting institute for the project is Renmin University of China Law School
The fiscal sponsor for the project is the Ford Foundation
Highlights of local CC events include: the Launch Event of the CC licenses and the International Conference on Intellectual Property and Creative Commons in the Digital Age held on March 29-30, 2006; the first CC licensed Photography Contest held from September 1 to October 15, 2007; the Awards Ceremony & Exhibition for the CC Photography Contest on November 4, 2007; the CC Salons in June 2006, November and December, 2007; and the CC Birthday events on December 15, 2006 and December 15, 2007.
An Descriptions of the Core Elements
Attribution: You let others copy, distribute, display, and perform your copyrighted work — and derivative works based upon it — but only if they give credit the way you request.
E.g. Xiaohong publishes her photograph with an Attribution license. Xiaowei finds her photograph online and wants to display it on the front page of his website. Xiaowei puts Xiaohong’s picture on his site, and clearly indicates Xiaohong’s authorship.
Noncommercial: You let others copy, distribute, display, and perform your work — and derivative works based upon it — but for noncommercial purposes only.
E.g. Xiaohong’s consent. Xiaohong publishes her photograph on her website with a Noncommercial license. Xiaowei prints Xiaohong’ photograph. Xiaowei is not allowed to sell the print photograph without Xiaohong’s permission.
No Derivative Works: You let others copy, distribute, display, and perform only verbatim copies of your work, not derivative works based upon it.
E.g. Xiaohong licenses a recording of her song with a No Derivative Works license. Xiaowei would like to cut Xiaohong’s track and mix it with his own to produce an entirely new song. Xiaowei cannot do this without Xiaohong’s permission (unless his song amounts to fair use).
(I would not include this fair use comment in the parentheses. fair use could be an exception to any of these license cases)
Share Alike: You allow others to distribute derivative works only under a license identical to the license that governs your work.
E.g. Xiahong’s online photo is licensed under the Noncommercial and Share Alike terms. Xiaowei is an amateur collage artist, and he takes Xiaohong’s photo and puts it into one of his collages. This Share Alike language requires Xiaowei to make his collage available on a Noncommercial plus Share Alike license. It makes him offer his work back to the world on the same terms Xiaohong gave her.
How to Publish Your Work with a Creative Commons License
Select a license from the above list of available licenses.
If you are publishing in analog form, simply include a statement on your work indicating you are using a Creative Commons license and then indicate the particular license you’ve chosen (e.g., “Attribution, Non-Commercial, No Derivatives” (BY-NC-ND) ).
If you are publishing on the web, include a statement on your work indicating a CC license and which particular license you’ve chosen, and copy the HTML code for that license from the CC web site to the website where you are publishing your work.

Founded in 2001 in the United States, Creative Commons (CC) is a non-profit organization that provides free tools, including the Creative Commons licenses and CC software, for authors, artists, composers and other content creators to easily mark their creative works with the freedoms and/or restrictions they want them to carry.
CC tools change the traditional “All Rights Reserved” statement of copyright into a voluntary “Some Rights Reserved” statement.
CC is dedicated to building a system of reasonable, flexible copyrights in the face of increasingly restrictive default copyright rules. It advocates and encourages legal sharing, remix, and reuse of creative works.
The first version of the CC licenses was released in December 16, 2002. The latest version of the CC licenses, released in 2007, is Version 3.0.
CC licenses have come to symbolize a worldwide knowledge sharing movement. To make local CC licenses available in various jurisdictions around the world, CC has developed an offshoot of its licensing project, Creative Commons International (CCi), which is dedicated to the porting of jurisdiction-specific CC licenses, with help from the member jurisdictions.
The project leads appointed by CCi are responsible for the local CC projects. The local affiliated institutions selected by CCi also act as support institutions to the local CC projects.
As of April, 2008, 45 jurisdictions have now officially launched a local version of the CC licenses.
The Local CC Project in China Mainland
Creative Commons China Mainland is the official local CC project. It is responsible for porting and promoting the China Mainland version of the Creative Commons licenses.
The project started the process of porting the CC licenses version 2.5 early in 2005. The China Mainland version of the CC licenses was officially launched in Beijing on March 29, 2006.
Creative Commons China Mainland is being maintained by a project team consisting of volunteers from various areas of expertise including law, the arts, and technology.
The project is also supported by an International Advisory Board which is composed of leading scholars, artists, judge, government representatives, and key members of the public sector.
The hosting institute for the project is Renmin University of China Law School
The fiscal sponsor for the project is the Ford Foundation
Highlights of local CC events include: the Launch Event of the CC licenses and the International Conference on Intellectual Property and Creative Commons in the Digital Age held on March 29-30, 2006; the first CC licensed Photography Contest held from September 1 to October 15, 2007; the Awards Ceremony & Exhibition for the CC Photography Contest on November 4, 2007; the CC Salons in June 2006, November and December, 2007; and the CC Birthday events on December 15, 2006 and December 15, 2007.
An Descriptions of the Core Elements
Attribution: You let others copy, distribute, display, and perform your copyrighted work — and derivative works based upon it — but only if they give credit the way you request.
E.g. Xiaohong publishes her photograph with an Attribution license. Xiaowei finds her photograph online and wants to display it on the front page of his website. Xiaowei puts Xiaohong’s picture on his site, and clearly indicates Xiaohong’s authorship.
Noncommercial: You let others copy, distribute, display, and perform your work — and derivative works based upon it — but for noncommercial purposes only.
E.g. Xiaohong’s consent. Xiaohong publishes her photograph on her website with a Noncommercial license. Xiaowei prints Xiaohong’ photograph. Xiaowei is not allowed to sell the print photograph without Xiaohong’s permission.
No Derivative Works: You let others copy, distribute, display, and perform only verbatim copies of your work, not derivative works based upon it.
E.g. Xiaohong licenses a recording of her song with a No Derivative Works license. Xiaowei would like to cut Xiaohong’s track and mix it with his own to produce an entirely new song. Xiaowei cannot do this without Xiaohong’s permission (unless his song amounts to fair use).
(I would not include this fair use comment in the parentheses. fair use could be an exception to any of these license cases)
Share Alike: You allow others to distribute derivative works only under a license identical to the license that governs your work.
E.g. Xiahong’s online photo is licensed under the Noncommercial and Share Alike terms. Xiaowei is an amateur collage artist, and he takes Xiaohong’s photo and puts it into one of his collages. This Share Alike language requires Xiaowei to make his collage available on a Noncommercial plus Share Alike license. It makes him offer his work back to the world on the same terms Xiaohong gave her.
How to Publish Your Work with a Creative Commons License
Select a license from the above list of available licenses.
If you are publishing in analog form, simply include a statement on your work indicating you are using a Creative Commons license and then indicate the particular license you’ve chosen (e.g., “Attribution, Non-Commercial, No Derivatives” (BY-NC-ND) ).
If you are publishing on the web, include a statement on your work indicating a CC license and which particular license you’ve chosen, and copy the HTML code for that license from the CC web site to the website where you are publishing your work.
